The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the presentation of a new 28-point plan for resolving the conflict appeared – temporarily – to have been stabilised. A senior US official spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of rocket attacks on Kyiv.

The Rhythm of Peace Talks and Military Action

The succession of conflicting incidents captured the grim essence of the outgoing year. By day, political struggles are conducted: hopeful statements are issued from various governments. Considerable effort is devoted on containing particular approaches. By night, Moscow forcefully demonstrates the world that, for them, war remains the main instrument for achieving "peace".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is able to track projectile deployments from enemy soil, a capability enabled by timely intelligence. From vantage locations, military aircraft that had been deployed to engage hostile aerial threats streaked across the sky – modern combat jets provided to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems engaged: several firings deployed against a Russian ballistic missile. This was a advanced protection mechanism at work, probably provided by partner states. Every firing jolts you unexpectedly, causing tremors. The brief panic quickly gives way to sober acceptance: perhaps the hostile projectile won't cause damage this time, sparing the city from ruin and further power outages.

Persistent Threats

Soon after, a heavy machine gun opened up on a aerial vehicle in the vicinity, part of a mobile-fire group – most likely Western-made equipment. Regrettably, the bullets missed the hostile drone – it pressed on overhead toward its destination.

Periodically, this carried on until dawn. Kyiv greeted the daybreak reports: multiple fatalities, damage and infrastructure problems in many homes as a result of the nocturnal offensive. As typically, everyone still went about their day – experiencing conflict. But those entire period demonstrated Ukraine's critical military reliance on international aid – a dependence that neighboring countries are demonstrably unable to substitute in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from American leadership sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new proposal from US leadership follows the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually win the battle. This cycle will, certainly, continue.

Strategic Calculations

It is convenient to criticize specific actors of repeatedly advocating Russian terms. But that does not seem to be the entire situation. American leadership functions according to a principle well known to seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The American government believes that it is impossible to force Russia to abandon the land that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, US leadership does minimal to prevent Kremlin actions, through words or deeds, from thinking that the current condition will not shift further in its advantage in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its supporters are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to end hostilities, but they will persist as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but avoiding a total frontline collapse until conditions improve in its advantage.

Present Conditions

Objectively, there are no actual prerequisites for a ceasefire. Now, individual motivations are entering the equation: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unworkable, so that their focus does not move to internal issues. And although their objective will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a just a single week to eliminate the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by Washington, resistance by Ukraine and the remaining European nations, along with calming attempts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are founded on Moscow's terms and reflect specific hesitation to modify developments, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, primarily depend on ongoing international assistance.
